The Office of the African National Congress (ANC) Chief Whip Jackson Mthembu has lashed out at the Democratic Alliance (DA) after its call for the removal of the Public Protector advocate Busisiwe Mkwebane and her Deputy Advocate Kevin Malunga.
In a statement issued by the office of the ANC Chief Whip, “DA has submitted a complaint in Parliament against Mkhwebane and Malunga calling for their removal of the Public Protector and instituted an inquiry into the Deputy Public Protector.”
The ANC has come out to criticized DA’s bid to institute proceedings against the Public Protector “[t]he call have absolutely no grounds and remain unfounded, Section 194(1) (a) of the constitution states quite clearly that the Public Protector may be removed from office on a finding of “misconduct, incapacity or incompetence” by a committee of the National Assembly,” says Mthembu.
The ruling party maintains that there is no findings of misconduct against Advocate Mkhwebane handed down by any committee of Parliament.
The ANC says it is not for the first time it experienced similar challenges with the DA, the majority party articulated that the DA has misled the public previously after feeding them with a rumor that the Public Protector was taken to judicial review.
Based on the reports, Mkhwebane was aware of these claims, saying the reports do not reflect negatively.
The majority party says it is not surprised by the action performed against the Public Protector. “Mkhwebane was not their preferred candidate for the position of Public Protector”.
The ANC has labeled the claims as a vendetta the DA has against the current Public Protector.
This follows the claims by the DA accusing the deputy Public Protector of terminating a probe into the Ekurhuleni Municipality unlawfully.
Meanwhile, the ANC has call on the Portfolio Committee on Justice and Correctional Services to reject the public stunt by the DA integrity of the Office of the Public Protector.
